Terms of Service
1. Scope
These Terms of Service ("Terms") govern the use of the platform Invoicely (available at get-invoicely.com, hereinafter "Service"), operated by ByteClick — Rachid Damergi, Stammheimerstraße 34, 50735 Köln, Germany (hereinafter "Provider").
By registering for and using the Service, you ("User") accept these Terms.
2. Description of Service
Invoicely is an AI-powered platform for automated invoice processing. The Service includes, but is not limited to:
- Automatic capture and extraction of invoice data
- AI-powered categorization of line items
- Spend analysis and reporting
- Price comparisons and price trend tracking
The exact scope of features depends on the selected plan.
3. Registration and User Account
- Use of the Service requires registration.
- The User is obligated to provide truthful information and to keep their login credentials confidential.
- The User is responsible for all activities conducted under their account.
- The Provider reserves the right to suspend or delete accounts in the event of a violation of these Terms.
4. Plans and Payment
- Available plans and their pricing are listed on the website.
- Paid plans are billed on a subscription basis (monthly or annually).
- Payment is processed through the payment service provider Stripe. Stripe's terms of use apply additionally.
- In the event of non-payment, the Provider reserves the right to restrict or suspend access to the Service.
5. Free Trial
- Where offered, the free trial allows use of the Service for a limited period.
- After the trial period expires, the account will be converted to the free plan unless a paid plan is selected.
- No automatic charges will be made after the trial period without the User's explicit consent.
6. Acceptable Use
The User agrees to:
- Not use the Service for any unlawful purpose
- Not upload any content that violates applicable law
- Not interfere with the technical infrastructure of the Service
- Not perform automated access (bots, scraping) without prior authorization
- Not infringe on the rights of third parties
7. Data Protection
The protection of personal data is important to us. For details on data processing, please refer to our Privacy Policy.
Uploaded invoice data is processed exclusively for the purpose of providing the Service and is not shared with third parties unless required for service delivery or mandated by law.
8. Availability
- The Provider strives for high availability of the Service but cannot guarantee uninterrupted access.
- Maintenance work and technical issues may lead to temporary restrictions.
- The Provider is not liable for outages caused by force majeure, technical failures of third-party providers, or circumstances attributable to the User.
9. Liability
- The Provider is fully liable for intent and gross negligence.
- In cases of simple negligence, the Provider is only liable for breaches of material contractual obligations and limited to the foreseeable, contract-typical damage.
- Liability for data loss is limited to the typical recovery costs that would have arisen if regular backups had been performed.
- The results of AI-powered invoice processing are provided without guarantee of completeness or accuracy. The User is responsible for verifying the extracted data.
10. Termination
- The free plan can be terminated at any time by deleting the account.
- Paid subscriptions can be cancelled at the end of the respective billing period.
- In the event of a violation of these Terms, the Provider may terminate the contract without notice.
- After termination, the User's data will be deleted within 30 days, unless statutory retention obligations apply.
11. Changes to Terms
- The Provider reserves the right to modify these Terms.
- Material changes will be communicated to the User via email or through the Service.
- Continued use of the Service after the changes take effect constitutes acceptance.
12. Final Provisions
- The laws of the Federal Republic of Germany shall apply.
- Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
- The place of jurisdiction is Cologne (Köln), to the extent permitted by law.
